It is not uncommon for teenagers to want to do things they are not allowed to do. Things like smoking, drinking and doing drugs all fall on the list of forbidden things, but one mother decided to allow her daughter and friends to do all these things and more at her house and it resulted in felony charges. The mother admitted to her Alcoholics Anonymous sponsor that she allowed her 16-year-old daughter and friends to come over and drink alcohol, smoke marijuana, and play naked Twister. The sponsor went to the police with this information and the mother was charged with Contributing to the Delinquency of a Minor.

What is Contributing to the Delinquency of a Minor in Larimer County?

C.R.S. 18-6-701 – Contributing to the Delinquency of a Minor – is defined by Colorado law as:

Any person who induces, aids, or encourages a child to violate any federal or state law, municipal or county ordinance, or court order commits contributing to the delinquency of a minor. For the purposes of this section, the term “child” means any person under the age of eighteen years.

Because the woman encouraged the teenagers to break the law by drinking and smoking marijuana, she faces this felony charge. As a class 4 felony in Larimer, Boulder, and Grand County, Contributing to the Delinquency of a Minor is punishable by confinement in the Colorado Department of Corrections for 2 to 6 years with a 3 year parole and $2,000 to $500,000 in fines.

The mother is facing two counts of Contributing to the Delinquency of a Minor. This means if she pleads to or is found guilty of both counts, the judge will sentence her on each count and decide to run her sentences concurrent or consecutive. If the judge chooses concurrent sentences, the maximum amount of time she would spend in prison is 6 years because she would be serving both sentences at the same time. If, on the other hand, the judge chooses consecutive sentences, the woman would serve each of her sentences separately, meaning she could spend a maximum of 12 years in prison.
